The BHO transition team is already showing its hands to move towards socialism by announcing that he will looking for Supreme Court Jurists that are "progressive."
Now in legal terms this means that he will be appointing and getting them approved by a very heavily populated Democratic Senate, jurists that see the Constitution as a progressive, living document. This is code for being able to interpret the US Constitution according to what they want society to be.
It is the antithesis of jurists that are strict constructionist meaning those that believe the Constitution should be interpreted according to how the founding fathers wrote it with adjustments for technology and/or common sense.
With the last 7 court judges appointed by Republicans, the Democrats are going to make sure that they get some very liberal, activist Supreme Court justices in place during the next 4 to 8 years. Now this may sound very bad for conservatives, but remember the two oldest judges thinking of retiring are liberals, so to reappoint liberals would just continue the 5-4 (Justice Kennedy as the swing vote) stalemate of the current Court makeup.
It is the concept that the Constitution is a living document that is disturbing to me. If you want to change the Constitution towards more socialistic perspectives then use the method the Constitution allows for changes: the Amendment process. This puts the changes into the hands of the governed, not in the hands of jurists.
Remember, the guiding principle of the US Constitution is that is government by the permission of the governed, and if the government ceases to be such, then the founding fathers told us we had the right to change that government.
I believe that the divided nature of this country can only last for so long before we have such a deep divide that a new Constitutional Convention is called, or a modern-day union split occurs. I also believe that if BHO and his SMDC go too far you may see that within the next 8 years.
Don't think it can't happen. It happened once, and very well can happen again.
